1. Who we are & what this covers

MyDavisCalifornia.com is an independent local guide and community news resource for Davis, California. The Site includes editorial articles and opinion, a directory of local businesses and places, an interactive map, real estate and rental information, a shop, optional paid memberships, an advertising/Partner Program for local businesses, and the MyDavis Predictions Market. These Terms of Service (“Terms”) apply to everyone who visits or uses any part of the Site.

We are an independent publication. We are not affiliated with, endorsed by, or sponsored by the City of Davis, Yolo County, the University of California, any school district, any developer or development project, any political campaign, or any government entity, except where expressly stated.

2. Acceptance of these terms

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy (Section 20). If you do not agree, please do not use the Site. If you use the Site on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

3. Eligibility & accounts

General browsing of the Site is open to the public. Certain features — including creating an account, purchasing from the shop, holding a membership, advertising with us, or participating in the Predictions Market — may require you to be at least 18 years old. The Predictions Market specifically requires you to be 18 or older (see Section 9).

If you create an account, you agree to provide accurate information, to keep your login credentials confidential, and to be responsible for all activity that occurs under your account. Notify us promptly at hi@mydaviscalifornia.com if you suspect unauthorized use.

4. Editorial content & not professional advice

Articles, guides, rankings, opinion pieces, and similar content reflect the views and editorial judgment of MyDavisCalifornia and are provided for general information and community interest. Opinions are opinions, not statements of fact.

Our content is not professional advice. Real estate data, affordability calculators, market analysis, rental figures, predictions, and any financial, legal, tax, medical, or other subject-matter information on the Site are provided for general informational purposes only and are not a substitute for advice from a qualified professional. Figures and estimates may be approximate, may rely on third-party sources, and may become outdated. Do not rely on them for financial, legal, or purchasing decisions without consulting a licensed professional. Any calculators or estimates are illustrative only.

We work to keep information accurate and current, but we do not warrant that any content is complete, accurate, or up to date, and we are not liable for decisions made in reliance on it.

5. Business listings & the directory

The Site includes listings, mentions, and recommendations of local businesses, venues, and places. These are provided for the convenience of our readers.

• A free mention or listing does not imply that a business is a paying partner, nor does it imply that business’s endorsement of us.
• Listing details (hours, prices, addresses, offerings) may change without notice. We do not guarantee accuracy and encourage you to confirm directly with the business.
• Inclusion in the directory is at our editorial discretion. A business may request a correction, an update, or removal of its free listing by emailing hi@mydaviscalifornia.com, and we will respond reasonably.
• References to third-party businesses do not constitute an endorsement of, or responsibility for, their products, services, or conduct.

6. Partner Program & advertising

Local businesses may purchase advertising placements through the MyDavis Partner Program, including Partner Badges, dedicated listing pages, randomizer inclusion, and deal features, on the terms presented at the time of purchase.

• What you get: the specific placements described at purchase. Features, formats, and the pages on which they appear may evolve as the Site changes; we will provide a reasonably equivalent placement if a specific format is discontinued.
• No guaranteed results. We do not guarantee any particular level of traffic, clicks, leads, sales, search ranking, or other outcome from a placement. Advertising performance depends on many factors outside our control.
• Fees & term. Partner fees, billing periods (e.g., quarterly or annual), and any seasonal pricing are those stated at purchase. Unless otherwise agreed in writing, fees are due in advance for each term.
• Refunds & cancellation. Except where required by law or otherwise agreed in writing, Partner fees are non-refundable once a placement period has begun. You may decline to renew at the end of a term. We may pause or remove a placement for non-payment or for content that violates these Terms or applicable law.
• Your responsibilities. You are responsible for the accuracy and legality of the logos, copy, offers, and links you provide, and you grant us a license to display them in connection with your placement. You confirm you have the rights to all materials you supply.
• Editorial independence. Buying a placement does not buy editorial coverage, a particular review, or influence over our reporting or opinions. Paid placements are identified as such.
• We may decline or remove any advertising at our discretion, including content we consider misleading, unlawful, or inconsistent with the Site.

7. Shop & orders

The Site may offer products for sale. By placing an order you agree to the price and description shown at checkout.

• Prices and availability may change, and we may correct errors, cancel an affected order, and refund any amount charged if a product was listed with an incorrect price or description.
• Payments are processed by third-party payment providers. We do not collect or store your full payment card details.
• Returns & refunds: unless a specific policy is stated at the point of sale, physical-goods returns may be requested by contacting hi@mydaviscalifornia.com within 14 days of delivery; items must be unused and in original condition, and certain items (including digital products and final-sale items) are non-returnable. Refunds, when issued, are made to the original payment method.
• For physical goods, risk of loss passes to you on delivery to the carrier; delivery times are estimates.

8. Insider memberships

We may offer paid memberships (“Insider” or similar) that provide access to certain content or features.

• Billing & automatic renewal. Paid memberships may be billed on a recurring basis (for example, monthly or annually) and, where offered as a subscription, renew automatically at the then-current rate until you cancel. The renewal terms, price, and frequency are disclosed at sign-up.
• Cancellation. You may cancel at any time through your account or by emailing hi@mydaviscalifornia.com. Cancellation stops future renewals; it takes effect at the end of the current paid period.
• Refunds. Except where required by law, membership fees already paid for the current period are non-refundable, and cancellation does not entitle you to a partial-period refund.
• Changes. Membership benefits may change over time. If we change the price of a recurring membership, we will give you notice and the change will apply to your next renewal; you may cancel before it takes effect.

9. MyDavis Predictions Market

The MyDavis Predictions Market (the “Predictions Service”), at predictions.mydaviscalifornia.com, is a community engagement platform that lets registered users make predictions on the outcomes of local Davis ballot measures and civic events using a virtual currency called “MyDavisCoins.” It is for entertainment and community engagement only.

The Predictions Service is NOT a gambling platform, a financial exchange, a securities market, a regulated prediction market, or a betting service. No real money can be won, earned, or cashed out.

9.1 MyDavisCoins

• MyDavisCoins have no monetary value whatsoever and are not currency, securities, commodities, or any financial instrument.
• They cannot be redeemed, exchanged, or converted into cash, credit, real currency, or anything of monetary value, at any time, under any circumstances.
• They cannot be transferred between users or to any third party.
• They are non-refundable, and any donation made to obtain them is final.
• We may modify, limit, or reset MyDavisCoins balances at any time, with or without notice, and may discontinue the system or the Predictions Service at any time.
• MyDavisCoins may be forfeited if you violate these Terms.

9.2 Free coins & donations

• New users receive 100 MyDavisCoins at no cost on registration, subject to these Terms; we may modify or discontinue this offer at any time.
• Users may obtain additional MyDavisCoins through voluntary donations (minimum $10.00 USD) processed by third-party providers such as PayPal; we do not store your financial information.
• All donations are voluntary support for MyDavisCalifornia’s community journalism and are final and non-refundable under all circumstances, including dissatisfaction, account termination, or discontinuation of the Service.
• MyDavisCoins received in connection with a donation are a token of appreciation, not a product or service being purchased.
• MyDavisCalifornia is not a registered 501(c)(3) nonprofit; donations may not be tax-deductible. Consult your tax advisor.

9.3 Predictions & outcomes

• Predictions are for entertainment and community engagement only. Prices and percentages shown reflect aggregate user activity and are not polls, surveys, forecasts, endorsements, or guarantees of any outcome.
• We make no representations about the accuracy of prediction prices as indicators of real outcomes, and we may resolve, cancel, void, or modify any market at our sole discretion (including for ambiguous outcomes, changed circumstances, or errors).
• You must be 18 or older to use the Predictions Service, and you may hold only one account. Creating multiple accounts to obtain extra free coins, or manipulating markets through fake or automated activity, is prohibited.

10. Your content & conduct

If you submit content to the Site — comments, reviews, tips, business information, advertising materials, or other submissions — you keep ownership of it but grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and adapt it in connection with operating and promoting the Site. You represent that you have the rights to what you submit.

You agree not to: use the Site for any unlawful purpose; impersonate others or misrepresent your affiliation; harass, defame, or harm others; post false or misleading information; infringe anyone’s intellectual property; attempt to gain unauthorized access to, reverse engineer, or disrupt the Site; use automated systems to scrape or overload the Site; or use the Site for unauthorized commercial purposes. We may remove content and suspend access for violations.

11. Intellectual property

The Site’s content, design, code, graphics, logos, and compilation are owned by or licensed to MyDavisCalifornia and protected by intellectual property laws. You may view and share links to our content for personal, non-commercial use. You may not reproduce, distribute, scrape, or create derivative works from substantial portions of the Site without our prior written permission. “MyDavis,” “MyDavisCalifornia,” and associated logos are our marks.

12. Third-party links & services

The Site links to and embeds third-party websites, tools, and services (for example, maps, rental listings, payment processors, and external business sites). We do not control and are not responsible for third-party content, products, services, or privacy practices. Your use of third-party services is governed by their terms, not ours.

13. Disclaimers

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT INFORMATION ON IT IS ACCURATE OR CURRENT.

We are not affiliated with the City of Davis, Yolo County, the University of California, any school district, any development project, any political campaign, or any government entity. The inclusion of any business, ballot measure, project, or civic event on the Site does not constitute an endorsement or opposition.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYDAVISCALIFORNIA AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, INCLUDING LOSS OF DATA, LOSS OF MYDAVISCOINS, LOST PROFITS, OR INABILITY TO ACCESS THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID OR DONATED TO US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless MyDavisCalifornia and its owners, operators, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your content or advertising materials, or your violation of these Terms or any law or third-party right.

16. Changes to these terms

We may modify these Terms at any time. Changes are effective when posted to this page with an updated “Last updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the modified Terms. For material changes to paid services, we will provide reasonable notice where required.

17. Termination

We may suspend or terminate your account or access to all or part of the Site at any time, for any reason, with or without notice. On termination, your right to use the Site ends; any MyDavisCoins balance is forfeited, and no donation or fee will be refunded except as required by law. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

18. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Yolo County, California, and you consent to their jurisdiction.

19. General provisions

These Terms, together with the Privacy Policy and any terms presented at the point of a specific purchase, are the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Site or business.

20. Privacy Policy

This Privacy Policy explains how MyDavisCalifornia collects, uses, and protects your information across the Site, including the shop, memberships, advertising, and the Predictions Market.

20.1 Information we collect

• Information you provide: when you create an account, subscribe, buy something, advertise with us, donate, or contact us, we collect details such as your display name, email address, business information, and the contents of your messages.
• Payment information: purchases and donations are processed by third-party providers (such as PayPal, Stripe, or our store platform). We do not collect or store your full card number or bank details.
• Information collected automatically: standard analytics data such as IP address, browser and device type, pages visited, referring pages, and time on the Site, collected through tools such as Google Analytics and similar technologies.
• Activity data: for account features and the Predictions Market, we record relevant activity (such as markets participated in and MyDavisCoins balance).

20.2 How we use it

We use your information to operate and maintain the Site and your account; to process orders, memberships, advertising, and donations; to communicate with you about the Service; to improve and develop the Site; to enforce these Terms; and to comply with legal obligations.

20.3 Cookies & analytics

We and our analytics providers use cookies and similar technologies to understand how the Site is used and to improve it. You can control cookies through your browser settings; disabling them may affect some features.

20.4 How we share it

We do not sell, rent, or trade your personal information. We share information with payment processors to complete transactions, with service providers who help us run the Site (such as hosting and analytics), and when required by law or legal process. Your display name, public reviews, and Predictions Market activity may be visible to other users.

20.5 Your choices & rights

You may request access to, correction of, or deletion of your personal information by emailing hi@mydaviscalifornia.com. California residents may have additional rights under California privacy law, including the right to know what personal information we hold and to request its deletion; we will honor verified requests as required by law. If you request account deletion, your MyDavisCoins are forfeited and prior donations are not refunded. You can opt out of marketing emails using the unsubscribe link.

20.6 Children

The Site is intended for a general audience and is not directed to children under 13, and account-based and paid features require you to be 18 or older. We do not knowingly collect personal information from children under 13; if you believe a child has provided us information, contact us and we will delete it.

20.7 Data security & changes

We use reasonable measures to protect your information, but no method of transmission or storage is completely secure, and we cannot guarantee absolute security. We may update this Privacy Policy from time to time; changes are posted here with an updated date.
